The following Gilmer County Schools policy is up for public comment until Thursday, August 23, 2012.

 

GILMER COUNTY SCHOOLS

INTRA-COUNTY STUDENT TRANSFER

POLICY 5118

The Superintendent shall cause to be published both a text description and a map of the attendance area for each school. Proposed modifications of attendance areas shall be placed on first reading at a regularly scheduled meeting. The Board shall not take action upon such proposed modification until the next ensuing regularly scheduled meeting.


Exceptional Students.

The “home school” for exceptional students shall be within the attendance area of residence unless a student’s IEP designates a school outside the area of residence based upon educational/related services programming needs.


Attendance Requirements.

Except as hereinafter provided, students shall be required to attend the appropriate school within the attendance area where they reside. Residence shall be determined by the residence of the custodial parent[s], guardian or legally responsible adult or institution.


School Registration.

Applications for admission to the public schools shall be made at the appropriate school located within the attendance area of student residence. The principal or other person responsible for admission and registration procedures may require the submission of information to verify residence. If admission is sought at a school outside the attendance area of the student resident, application shall be made to the Superintendent’s designee.


Transfer Criteria.

The following criteria shall be considered with respect to applications to attend schools outside the attendance area of student residence:

1. Student-teacher ratio limitations,

2. Any factors relevant to the best interest of either the student or the school district.

3. With respect to exceptional students, receipt of written acknowledgment that the basis for the application is non-programmatic.


Out of Area Enrollments/Continuing Status.

Upon the approval of an application of a student to attend a school outside the area of residence, such student shall be deemed to be a resident of the receiving school’s attendance area for purposes of this policy. Furthermore, any student who has been approved to attend school outside the area of residence may elect to be considered a resident of the attendance area of school or schools fed by the school to which the student has transferred. Provided, however, in the event any applicable pupil-teacher ratio is exceeded by virtue of out-of-area transfer students, such transfer students shall be subject to return to the school in the area of residence. For all approved student transfers as of the effective date of this policy, students subject to return shall be returned on a last in / first-out basis. For student transfers approved after the effective date of the policy, students shall be returned on a random selection basis determined by the Superintendent.


Superintendent-Initiated Transfers.

The Superintendent may transfer any student from one school to another for reasons determined to be in the best interest of the school district.


Appeals.

Any decision by the Superintendent or his or her designee to either disapprove a request to enroll a student in a school outside the attendance area of a student’s residence or to transfer a student from one school to another may be appealed to the Board. The Board’s decision on any such appeal shall be final.


Transportation.

Students who are admitted to schools outside the attendance area of residence shall not be entitled to transportation. However, such students may ride on existing school bus routes on a space-available basis.
Review Schedule.

This policy shall be reviewed in accordance with the Policy Review Schedule published by the Superintendent.

The local board has no say in approving or disapproving this. Citizens need to stand up to this. If policies like this one are allowed, then what is going to be next?

“for the best interest of the school district”??? I thought education was for the best interest of the student, not the district.  And why is the superintendent, and not the school board, in charge of this?  We elect our school board and they should be making the decisions.  The superintendent should be in charge of fulfilling the wishes of the board, NOT a dictator!  With a policy like this, the school board is irrelevant and that’s not the way freedom works.

Who can appeal to the Board of Ed? Not Gilmer County. Ask Simmons and he will tell you all he can do at a Board meeting is lead the pledge of allegiance.What part of they have no power is so hard to understand?  The purpose of such rules is to control takeover counties and move the kids as they please.  If the current rule won’t let you do what you want just write a new one. No vision of future impact, no level the playing field, no thought put into it at all.  And we wonder why they say WV has the most restrictive and burdensome system for education the auditors have seen?

I see that this is labeled a Gilmer County Schools Policy and not a WV State Dept of Education policy. If the County Board of Education has no authority, who in the county has the power to grant a state Superintendent the ability to change county policy for transporting Gilmer County children across county lines which I take as the meaning of “attendance area” and the Super’s power to transfer according to needs of “school district”. Who will map these areas and districts?  Are they to be made public anytime soon?

It becomes more obvious everyday the citizens of Gilmer County are receiving dispicable treatment, by the State, under the Marple direct leadership.

It is also, no wonder the Governor is afraid to tackle this issue.  Of course he is sidetracked by his re-election campaign currently. 

The vote block, controlled by the education lobby, is sacred ground not to be tampered with, at great risk if you dare.

When teachers, school staff, and parents fail to speak out for what is right, we *all* can expect this treatment.

Now too, it has become obvious, on the list of priorities, the children are last in line.

The intercounty/Lewis County school district map might have to be gotten from the Lewis County Board of Ed.
