WV Municipalities May Garnish Tax Refunds

Taxpayers who fail to pay municipal fines in West Virginia could receive lighter refund checks.

State Tax Commissioner Christopher G. Morris announced Tuesday that taxpayers who fail to pay municipal fines and other costs within 270 days will be subject to having their personal income tax refunds withheld or denied.

Municipalities that sign up for the legislatively mandated program will send lists of delinquent taxpayers to the state tax commissioner.

The State Tax Department will then notify affected taxpayers of the amount being withheld.

The West Virginia Office of Tax Appeals will hear all appeals.
