Gilmer County Assessor, Gary L. Wolfe, would like to announce that William R Moodispaw, DVM, will be at the following named places on the dates listed below, to vaccinate dogs and cats AS REQUIRED BY WV CODE §19-20A-1.

All dogs and cats, which have reached SIX MONTHS OF AGE AND HAVE NOT BEEN VACCINATED WITHIN THE PAST 24 MONTHS, are required to be vaccinated before June 01, 2013.

The fee for rabies vaccination will be $8.00 according to WV Code §19-20A-1.

Mary Sue Frashure Osborn

Age 63, of Ellis Road, Linn, West Virginia, departed this life at 3:30 AM, Saturday May 04, 2013 at her residence following a brief illness.

Born November 05, 1949 in Gilmer County, West Virginia, daughter of the late William Earl and Minnie Fern McHenry Frashure.

Sue was a homemaker who loved to take care of her family, cooking, gardening, sewing, and quilting.

She was a member of the Otterbein Methodist Church.

She enjoyed West Virginia University sports with a special interest in their Basketball program.

On October 04, 1974 she was united in marriage to Kenneth Osborn Jr., who survives at their Ellis Road home.

Surviving are 2 daughters, Susan Hornbeck and husband Doug of Parkersburg, West Virginia, and Kelly Osborn of Parkersburg, WV; 2 grandchildren Caleb and Leah Hornbeck of Parkersburg, WV; 9 siblings, Billie Radcliff and husband Arnold Sam of Weston, West Virginia; Beulah Robinson of Tanner, West Virginia; Lou Runyon and husband Denzil of Normantown, West Virginia; Ann King of Alum Bridge, West Virginia; James Frashure and wife Nadine of Parkersburg, WV; Ronald Frashure and wife Nancy of Glenville WV; Larry Frashure and wife Joy of Glenville WV; Faynell Gainer and husband Terry of Weston, WV; Jerry Frashure and wife Cheryl of Parkers burg, WV; and 1 cousin whom she was raised with, Avin Lowther and wife Elizabeth of Linn, West Virginia.

Along with her parents, Sue was preceded in death by her Aunt and Uncle Alva and Buryel Lowther who raised her from the age of 5.

Funeral Services will be conducted at the Ellyson Mortuary Inc., 2 Vanhorn Drive, Glenville WV 26351 at 12:00 Noon, Tuesday, May 07, 2013 with Pastor Bryon Bukovesky officiating.

Burial will follow in the Alice Cemetery, on Alice Road.

Friends may call from 10:00 AM - Noon, the funeral hour on Tuesday at the Mortuary.

In lieu of flowers the family requests memorial contributions be made to the Glenville First Baptist Church Cancer Fund or Hospice Care Corp. of Burnsville.

of West Union, WV,  departed this life on Friday, May 03, 2013 in the Heartland Nursing Home.

She was born April 17, 1918 a daughter of the late Jesse and Cora Hitt Golden.

Surviving are ten daughters, Linda Bennington, Clarksburg, Bonnie (Harold) Stalnaker, Lincolnton, NC, Fay (Tom) Whitlatch, Hoschton, GA, Nancy (Eddie) Vanscoy, Mineral Wells, Rose Russell, Parkersburg, Wendy Sandstrom, West Union, Margie (Virgil) Matheny, Clarksburg, Judith McElwain, West Union, Karen Ross, Clarksburg and Joellen (Grant) Trent, West Union, one son, Carroll Bennington, Baltimore, MD, 16 grandchildren, over 25 great grandchildren and one sister, Velma Stover, Weston. She was preceded in death by two sons, Steven and Gerald “Jerry” Bennington, one daughter Sharon Bennington, sisters and brothers, Clifford Golden, Hobert Golden, Irene Golden, Pauline Golden and Jean Woofter.

Mrs. Bennington had worked at the Britton’s Rest Home as a CNA for many years and had worked at the Doddridge County Senior Citizens. She loved quilting, reading, growing flowers and spending time with her children and grandchildren. She was a loving mother and grandmother and will be sadly missed by her family.

Funeral services will be conducted in the Spurgeon Funeral Home, 212 Front St., West Union on Wednesday, May 08, 2013 at 1 PM with Pastor Bill Davis presiding.

Interment will follow in the Rock Grove Cemetery, Sleeth Run Rd, Linn, WV.

The family will receive friends in the funeral home chapel on Wednesday, May 08, 2013 from 11 AM - 1 PM.

Budge “Budgie” R. Frashure

Age 62, passed away at 5:35 PM at his residence in Linn, WV on April 27, 2013 following an unexpected illness, with his beloved Collie dog and best friend, Levi by his side.

He was born on April 06, 1951 in Weston, WV a son of the late Roy “Bob” and Goldie M. Keith Frashure. One brother, Bobby J. Frashure, and one nephew, Bobby Ray Frashure, also preceded him in death.

On January 02, 1970 he married the former Dottie Grogg and they remained married until 1998.

He is survived by one sister, Rosalie Heater and husband Orie of Orlando, WV; two daughters: Wendy Mathess and husband Steve of Jane Lew, WV; Nikki Frashure of Farmington; two grandsons: Breyer and Branson Mathess of Jane Lew; two nephews: Ricky J. Frashure of Linn, and Lee Frashure of Jane Lew; and one niece, Sherry Peters of Good Hope, WV.

Budge devoted his younger years to his work as a heavy equipment operator in the coalfields from 1974-1997. He had a well-earned reputation among the employees for being the “best operator around”. He never missed a day’s work for years, even during illness. He also worked at Lignetics until leaving to care for his elderly mother until her death in 2010.

He loved to watch Western movies in his free time and play with his Collie, Levi. His family and friends will sadly miss him.

There will be a private Family and Friends Gathering at the Hiney Cemetery in Linn, WV.

Linn: The Construction of the Inter-county School Should Begin Soon

In a few weeks, the beginning phases of construction of the first Inter-County school in West Virginia should start.

The school site is located on the border of Gilmer and Lewis Counties in Linn, WV.

The school is to serve the students from Troy Elementary School in Troy, WV (Gilmer County) and Alum Bridge Elementary School in Alum Bridge, WV (Lewis County).

The Lewis County Board of Education approved Capitol Valley Contractors of Elkview, WV as the company to complete the site work at its meeting Monday, April 22, 2013.

The low bid was just over $1 million, according to Lewis County Board of Education President Paul Derico.

Age 87, Orrville, Ohio, went to be with the Lord on Saturday, April 20, 2013, at his residence with his family by his side.

He was born on April 23, 1925, in Glenville, WV, the son of Hoy and Edna (Messenger) McHenry.

He was united in marriage to Louvone Helmick on July 21, 1946, in Linn, WV. She survives.

Claude had been a resident of Orrville since 1962, and had been employed in the maintenance department for the Orrville City Schools for 13 years prior to retiring.

He was a member of the Orrville Christian Church, where he was a past president and member of the Faithful Followers Class.

He was a past president and former member of the Kidney Foundation of Wayne County for many years.

Claude enjoyed his grandchildren, watching softball at Orr Park, cooking and playing cards. He was a 23-year cancer survivor.

In addition to his wife, Louvone, he is survived by four daughters, Mary (Jim) Saunders Sr. of Canton, Linda (Junior) Kerns of Clyde, Sheila (Doc) Burrows of Willard, and Sally (Keith) Hartzler of Sterling; two sons, Eugene McHenry of Orrville and Richard (Tess) McHenry of Maineville; 12 grandchildren; numerous great-grandchildren and great-great-grandchildren; and a brother, Jim (Joann) McHenry of Glenville, WV.

He was preceded in death by his parents; daughter, Naomi Jackson; brothers, Hoy, Herman, Harley and Dana McHenry; and sisters, Irene Riffle, Pauline Wells and Opal McHenry.

Services will be held at Orrville Christian Church in Orrville on Wednesday, April 24, 2013, at 11:00 AM with Pastor Tom Ledford officiating.

Burial will take place at Crown Hill Cemetery in Orrville.

Friends may call at Auble Funeral Home in Orrville on Tuesday, April 23, 2013, 6:00-8:00 PM, or one hour prior to services at the church on Wednesday.

Delegate David Walker informed us that legislation first started by himself and Delegate Boggs on the governance of inter-county schools has been passed from the Education Committee by unanimous vote and is moving forward from that committee.

Also, an additional bill is in progress to set the standards for a clear exit plan after state intervention.

Massachusetts Woman Sentenced for Traveling to WV to Have Sex with a Minor from Linn Area

CARISSA HADS, age 25, of Quincy, Massachusetts, was sentenced on January 29, 2013, in United States District Court in Clarksburg by Judge Irene M. Keeley.

HADS was sentenced to 87 months imprisonment to be followed by lifetime supervision.

HADS entered a plea of guilty on October 10, 2012, to “Traveling in Interstate Commerce with the Intent to Engage in Illicit Sexual Conduct” on February 23, 2012, when HADS traveled from Massachusetts to North Central West Virginia to have sex with a minor from Linn, WV.

Court documents indicate that HADS posed as an 18-year old man on a social media website and also took steps to change her appearance in order to deceive the victim as to her true identity.

HADS met the alleged victim online in 2010 and the two communicated for over a year before the first in-person meeting took place.

HADS traveled at least three times from Massachusetts to visit the alleged victim, and was arrested at the Pittsburgh International Airport by F.B.I. agents on May 25, 2012, on one of her visits to the area.

As part of her plea, HADS agreed to the forfeiture of the computer and electronic equipment seized from her and her residence.

HADS was remanded to the custody of the United States Marshal pending designation to a
Federal institution.

The case was prosecuted by Assistant United States Attorney Shawn A. Morgan, Chief of the Criminal Division for the U.S. Attorney’s Office and investigated by the West Virginia Internet Crimes Against Children Task Force and the Federal Bureau of Investigation.

Age 75 of Sliding Run Road, Stouts Mill, West Virginia, departed this life at 8:43 PM Saturday January 19, 2013 in Ruby Memorial Hospital, Morgantown, West Virginia follow a brief illness.

Born November 29, 1937 in Gilmer County, West Virginia, son of the late Henry and Dottie Nicholas Cottrill.

Haymon was a member of the Sand Fork Church of God of Prophecy.

He enjoyed teaching younger generations how to survive, and before his health diminished he enjoyed hunting, turtle fishing, and gardening. Most of his working life was spent as a laborer and anyone that knew him knew he liked to work hard.

On October 03, 1990 he was united in marriage to Linda White Cottrill, who survives. Before they made their union official Haymon and Linda had been together since the early 1980’s.

Surviving are 2 sons and 2 daughters, David Cottrill and girlfriend Shannon of Stouts Mills, WV; Rose Craig and husband Freddy of Linn, WV; Rita Brown of Stouts Mills, WV; and James Jones and wife Pam of Glenville,  WV.

There are also 13 grandchildren,  14 great-grandchildren, 1 brother, Freddie Cottrill of Buckhannon, WV; and 1 sister, Hazel Walton of Buckhannon, WV,  surviving.

Along with his parents Haymon was preceded in death by 3 children Haymon Lynn Cottrill, Cheryl Miner, and John Jones. He was also preceded in death by 1 grandson, Robbie Cottrill, 1 infant grandson Frederick Craig, 1 infant great granddaughter Marissa Sumner, and 22 brothers and sisters.

Funeral Services will be conducted at the Ellyson Mortuary Inc. Glenville, West Virginia at 2:00 PM Sunday January 27, 2013 with Pastor Bryan Groves officiating.

Burial will follow in the Cottrill Cemetery on Sliding Run Road, Stouts Mills.

Friends may call from 4:00-8:00 PM Saturday at the mortuary.

Age 88 of Ellis Road, Linn (Gilmer County), West Virginia, departed this life at 7:00 PM, Friday, January 18, 2013, at Stonewall Jackson Memorial Hospital (Weston, West Virginia), following an extended illness.

He was born on September 15, 1924 in Gilmer County, WV and was the son of the late Rex F. and Dora Radcliff Wiant.

Russell worked in timber, coal mines, at the Louie Glass Factory, and retired from the WV Department of Highways. He loved CB radios and the friends he made on them, and also had a great passion for hunting and fishing. We all love Russell and will miss him deeply, we thank God for those years with us but look ahead to being in heaven some day with him.

Three daughters and one son survive: Linda Lue Tomey of Little Birch, West Virginia; Shelia Kay Wiant of Weston, West Virginia; Geraldine Lois Hershman of Linn, West Virginia; and Darrell Emmit Wiant and wife Joyce of Linn, West Virginia. 15 grandchildren also survive: Steve Wiant, John Wiant, Blaine Wiant, Chad Wiant, Chuck Sprouse, Scott Sprouse, BJ Sprouse, Anthony Wiant, Lillie Wiant, Scottie Queen, Brandon Queen, Nicole Queen, Brittany Wiant, Bryon Wiant, and Joey Wiant.

Along with his parents, Russell was preceded in death by two sons, Larry Gene Wiant and Russell Emmit Wiant, Jr., one grandson Terry Sprouse, three brothers, Donald, Rex, and Gene Wiant, and two sisters, Maxine McNair and Wanda Goff.

Funeral Services will be conducted at the Ellyson Mortuary Inc. in Glenville, West Virginia, at 11:00 AM on Wednesday, January 23, 2013 with Pastor Bryan Groves officiating.

Burial will follow in the Hiney Cemetery.

The mother is employed at Foodland and the father is employed at MEC construction.

Maternal grandparents are Benny and Lorrie McCure of Glenville, WV.

•  The last day of school before Christmas, an english teacher at GCHS caught students in the back of her classroom using marijuana and reported them to the principal. What is the deal with that?


•  It is horrible that examples of alleged misconduct at GCHS go unreported.  That failure is enabling the individuals who could care the least about decency. What it will take is a parent or another individual in the know to rise up to file a formal complaint about the sexual misconducts at school. Have any complaints been filed? If administrators know about problems and they fail to act it is my belief that they could be held accountable similar to what happened at Penn State.

Virginia M. “Kit” Messenger

Age 87, of Prestonsburg, KY, formerly of Linn (Gilmer County) departed this life at 5:05 AM Sunday, November 18, 2012 at the Riverview Health Care Center following an extended illness.

She was born August 02, 1925 in Tucker County, WV, a daughter of the late Howard Lee and Shada Wiseman Simmons.

Kit was a homemaker, loved crocheting, quilting, and especially camping with family and friends.

She was a member of the Oak Grove United Methodist Church at Baldwin, WV.

On May 23, 1942 she was united in marriage to Lester O. Messenger of Prestonsburg, KY.

One son and one daughter survive: John W. Messenger and wife Susan of Glenville and Linda M. Woofter and husband David of Eastpoint, KY. One brother, Ralph Simmons of Weston survives. Mrs. Messenger has nine grandchildren and 13 great-grandchildren surviving.

She was preceded in death by one son, Gary Messenger and three brothers, Gloy, Robert and Elmer Simmons.

Funeral services will be conducted at the Ellyson Mortuary, Inc., at 11:00 AM, Wednesday, November 21, 2012 with Rev. Gilbert Hart officiating.

Burial will follow in the Troy I.O.O.F. Cemetery, Troy, WV.

Friends may call from 6:00-8:00 PM on Tuesday, at the Mortuary.

»  The firearm antlered deer bag limit during the two-week buck season is two (one on the base license and one on an RG [resident] or RRG [nonresident] stamp). A hunter may take no more than three antlered deer per calendar year in all archery and firearms seasons combined.

»  The last day to purchase an additional buck deer gun tag (Class RG/RRG Stamp) was November 18, 2012. Class RG and Class RRG additional buck stamps can only be used to take an additional antlered deer in firearm buck season. Unused Class RG and Class RRG stamps may not be used in antlerless or muzzleloader seasons.

»  There are 10 counties or portions thereof (see the 2012 – 2013 Hunting and Trapping Regulations Summary) that require buck firearms hunters to take an antlerless deer during the antlerless firearms deer season (with Class N permit for residents or Class NN permit for nonresidents) prior to harvesting a second antlered deer during the buck firearms season.

»  All private and public lands in counties having a firearms antlerless deer gun season (Class N for residents and Class NN for nonresidents) will be open November 19 – December 01, 2012 (concurrent with the buck gun season), December 13 - 15, and December 28 – 31, 2012. Bag limits vary among counties but will be either one or three antlerless deer.

»  All deer must be field tagged and checked in within 72 hours of the time of kill or within 24 hours of the close of the season, whichever comes first. Additional deer may not be taken until all previously taken deer have been checked. Only one deer may be taken per day during the buck season.

»  Deer hunters spend an estimated $230 million in West Virginia, much of it in the rural areas of the state that depend upon the deer seasons for a large portion of their annual income.

»  In 2011, deer hunters in West Virginia harvested 60,157 bucks during the two-week buck season, an increase of 38 percent from the 2010 harvest. This is two percent less than the five-year average harvest of 61,428 and ranks 24th among all past years.

»  WVDNR forecasts that the buck harvest should be slightly higher for 2012. All regions should see a similar-to-higher harvest this year. The increased reproduction of 2011 and the mild winter of 2011-2012 should mean that there are plenty of 1.5-year-old animals for hunters. The overall mast conditions should be favorable. In addition, DNR has been conducting spotlight counts in many counties and have observed many large-racked animals for hunters to pursue.

»  Sunday hunting is legal in the following 14 counties on private land only: Boone, Brooke, Clay, Hancock, Jefferson, Lincoln, Logan, McDowell, Marshall, Mingo, Ohio, Wayne, Wetzel and Wyoming. The only Sunday that is open in these counties during the buck season is November 25, 2012. Hunters are reminded that deer gun seasons are closed in Logan, Mingo, McDowell and Wyoming counties.

»  Hunters are required to wear at least 400 square inches of blaze orange (about the size of a vest) as an outer garment for visibility and safety. Blaze orange camouflage patterns are legal as long as 400 square inches of blaze orange are displayed on the garment. A blaze orange hat is not required, but the hunter must have blaze orange visible from both the front and the back.

Age 72, of Elizabeth, WV, departed this life at 8:04 AM, Wednesday, October 31, 2012 in Camden-Clark Memorial Hospital , Parkersburg, WV following an extended illness.
She was born August 03, 1940 in Gilmer County, WV, a daughter of the late Floyd and Loreeta Self Peters.
Mary Ann had numerous jobs, the last being with Pennzoil as a secretary.  She really enjoyed life, she played the piano and sang at several churches and nursing homes or wherever they needed someone; she was very talented in arts, crafts and jewelry making; and was a homemaker and mother.

She attended the Bethel Baptist Church at Elizabeth.
She is survived by her husband Roger Hardbarger who survives at their Elizabeth home.
Also surviving:  a daughter, Lisa Groves and husband Carl of Elizabeth; 2 sons, James Lynn Thompson of Pullman, WV; and Eddie Joe Perine and wife Autumn of Parkersburg, WV; 3 brothers and 1 sister survive, Richard Peters of West Milford, WV; John Peters of Craigsville, WV; Mike Peters, Linn, WV and Sharon Radcliff of Jane Lew, WV.
Besides her parents she was preceded in death by 3 brothers, Carl, Lynn and Joe Peters and one sister, Nina Pyles.
Funeral services will be conducted at the Rock Grove United Methodist Church at 2:00 PM, Saturday, November 03, 2012 with Rev. James Brunty and Rev. Kenny Fisher officiating.

Burial will follow in the Rock Grove Cemetery.

Age 78, of 117 Abbott Run Road, Horner, WV died Monday, October 22, 2012 at his residence following an extended illness.

He was born July 2, 1934 in Lewis County a son of the late Lawrence and Rosa Call Gay.

In 1953 he married the former Janet Joan Belt who survives.

Also surviving are two daughters Barbara J. Ables of Weston, WV and Cheryl Phares of Linn, WV.

Two sons Roger D. Gay of Lake Floyd and Robert L. Gay of Weston.

8 grandchildren, 6 great grandchildren and one great great grandchild.

Mr. Gay was employed for several years at the Lewis County board of Education as a school bus driver and previously was employed by the WV Dept. of Highways.

He also painted and restored autos for several years.

He was a Methodist by faith.

Age 80, of 365 Ranges Run Road Roanoke, West Virginia passed away at 7:15 AM in the Crestview Manor Nursing Home and Rehabilitation Center in Jane Lew.

She was born in Webster County, West Virginia on June 10, 1932 a daughter of the late Worth O. Bennett and Gertrude Boggs Bennett.

On October 22, 1952 she married Ralph W. See Jr, who proceeded her in death on October 31, 1992.

She was also proceeded in death by one sister Alta Lucille Bennett and three brothers Orris Summers Bennett, Worthy Hollis Bennett and William Ottis Bennett.

She is survived by one son Ralph Edward See and wife Darlene of Roanoke. Two granddaughters Mary Katherine “Kathy” See of Roanoke and Deanna Darlene See Shackleford and husband Cale of Linn, WV. She is also survived by several nieces and nephews.

Mrs. see was a homemaker and worked beside her husband on the family farm. She loved to cook, garden, farming, photography and loved to sew.

She was a member of the Vandalia United Methodist Church and was a Sunday School teacher for years.

She was a 39 year member of the Vandalia Community Educational Outreach Service Club. She was a 64 year member of the Lewis County Farm Bureau. She was a past member of the Lewis and Upshur County Livestock Association.

Family will receive friends at the Hardman-Paletti Funeral Home 730 North Main Avenue, Weston on Friday, October 26, 2012 from 2:00-4:00 and 6:00-8:00 PM.

Funeral services will be held on Saturday, October 27, 2012 from the Hardman-Paletti Funeral Home Chapel with Reverend Dwayne Brown officiating.

Interment will follow services in the Weston Masonic Cemetery.

William Dawson Means

Age 92, of 2736 U.S. Highway 33 West, Weston, WV, passed away on October 22, 2012 at Stonewall Jackson Memorial Hospital following an extended illness.

William was born on December 06, 1919 in Hurst, West Virginia, son of the late Willie Ervin Means ad Grace Truman (Sprouse) Means.

On December 10, 1947 he married Eva R. (Cox) Means who survives.

Mr. Means is also survived by three daughters Pat Bush and husband Bob of Weston, Debbie Blackstone and husband Larry of Cincinnati, Ohio, and Brenda Lydon of Weston. Also surviving are four grandchildren Brian L. Bush and fiancé Janell Starner, Breanna A. Wilson and husband Chris, Jessica Krohn and husband Ryan, and Brittany Parks and fiancé Jonathan Oates, three great-grandchildren Ethan and Jobie Bush, and Karli Krohn, and several nieces and nephews.

In addition to his parents he was preceded death by one brother Fred O. Means and two sisters Virginia N. Means and Ruth Means.

Mr. Means was a retired well tender and compressor operator for Hope Gas Company. He was a graduate of Weston High School.

He was a member of the Liberty United Methodist Church on Straight Run in Lewis County where he was superintendent for almost fifty years.

He was a Veteran of the United States Army Air Force, and was a member of the Veterans of Foreign Wars and American Legion both of Jane Lew.

Family will receive friends at the Hardman-Paletti Funeral Home 730 North Main Avenue, Weston on Wednesday, October 24, 2012 from 6:00-8:00 PM.

Funeral services will be held on Thursday, October 25, 2012 at 1:00 PM from the Hardman-Paletti Funeral Home Chapel with Reverend Alan Neal and Reverend Russell Furr officiating.

United States Attorney William J. Ihlenfeld announced that CARISSA HADS,  age 25, of Quincy, Massachusetts, entered a plea of guilty on October 10, 2012,  in United States District Court in Clarksburg before Magistrate Judge John S.  Kaull.

HADS entered a plea of guilty “Traveling in Interstate Commerce with the Intent to Engage in Illicit Sexual Conduct” on February 23, 2012, when HADS traveled from Massachusetts to North Central West Virginia to have sex with a minor.

Court documents indicate that HADS posed as an 18- year old man on a social media website and also took steps to change her appearance in order to deceive the victim as to her true identity.

HADS met the alleged victim online in 2010 and the two communicated for over a year before the first in-person meeting took place.

HADS traveled at least three times from Massachusetts to visit the alleged victim, and was arrested at the Pittsburgh International Airport by F.B.I. agents on May 25, 2012, on one of her visits to the area.

As part of her plea, HADS has agreed to the forfeiture of the computer and electronic equipment seized from her and her residence.

HADS, who is in custody pending sentencing, faces up to 30 years imprisonment and a $250,000 fine.

The case was be prosecuted by Assistant United States Attorney Shawn A. Morgan, Chief of the Criminal Division for the U.S. Attorney’s Office and investigated by the West Virginia Internet Crimes Against Children Task Force and the Federal Bureau of Investigation.

Plea Deal in Works for Massachusetts Woman Who Posed as Boy, Allegedly Had Sex with WV Girl

A Massachusetts woman accused of posing as a 17-year-old boy to prey on a West Virginia girl intends to enter a plea next week in federal court.

U.S. Magistrate John Kaull entered an order Monday scheduling a Wednesday, October 10, 2012 hearing for 25-year-old Carissa Hads of Quincy, MA.

The document says she has entered a plea agreement with the government, but it does not specify details.

Hads’ public defender did not immediately respond to a message seeking comment.

Hads previously pleaded not guilty to one count of traveling in interstate commerce to engage in illegal sexual conduct.

Investigators say Hads pretended to be a 17-year-old boy and began an online relationship with the girl in 2010.

She visited the Linn, West Virginia teen at least three times and had a sexual encounter in February.

Age 66, of 183 4th St. Jane Lew, WV died at 4:45 AM, Sunday, September 23, 2012, at his residence following an extended illness.

He was born on February 27, 1946 in Sun Valley: son of the late John William and Irene K. Keister Smith.

On March 10, 1981, he married the former Cathy Lamb who survives. Also surviving are three sons, John Russell Smith and Teddy Dwayne Smith, both of FL, Robert Matthew Smith of Jane Lew; one daughter Barbara Jean Simonetta of FL; two step-sons, Christopher Robert Franklin of Jane Lew and Michael Brian Franklin of Weston; two grandchildren and five step-grandchildren.

Also surviving are five brothers, Chuck and Tom Smith, both of Alum Bridge, Jack Smith of Horner, Butch Smith of Lumberport and Randy Smith of Keiths Fork. He was preceded in death by one brother, Ronny Smith.

Mr. Smith was retired from the Weston Ford Garage with several years of service.

AN OPEN LETTER TO DELEGATE BRENT BOGGS

Delegate Boggs, I read with great interest your column in the Gilmer Free Press dated September 03, 2012, and find your Troy-Alum Bridge School statements more than a little disturbing.

In it, you say that you “have not committed to proposing legislation to create this governing board” (of the inter-county school).  Current Gilmer County Board President Simmons has informed many people both privately and publicly that you and others have been working hard and have had many meetings on pending legislation to do exactly that. You can understand how one might be just a little confused.

An elected official should certainly understand that WITHOUT A VOTE YOU HAVE NO VOICE IN GOVERNMENT AFFAIRS AND GILMER COUNTY HAS NO AUTHORITY AND NO VOTE AFTER THE STATE TAKEOVER OF OUR SCHOOLS.

I repeat, duly elected members of the Gilmer County Board of Education have no authority.  They have no vote.  Therefore, the people of this county have no voice that is Not State appointed and directed.

I know from personal conversations with you, emails sent and conversation with others who have previously communicated with Charleston representatives that you are fully aware of the state takeover of Gilmer County Schools.  I believe you do comprehend that the Gilmer County Board of Education has been stripped of its powers since June of 2011.  They have no voting power and no ability to take official action regarding any issue involving education and Gilmer County Schools.

To further refresh your memory, let me remind you that the State appointed Superintendent Ronald Blankenship acting for the State of West Virginia approved and submitted a facilities plan for Gilmer County Schools (which was prepared by and in the possession of State appointed architects) without any vote of this powerless Board and absent any appropriately representational input from Gilmer County citizens.

A State appointed and State paid Superintendent alone permitted the Lewis County Board of Education to place (with no Gilmer County Board of Education approval even possible), an inter-county school prototype within the borders of Lewis County on their own facilities plan. They authorized transfer of our students across county lines. There was subsequent SBA funding.

This man alone permits an illegal and non-representative (as defined by state requirements) CEFP committee to continue operations. This one man by virtue of a State granted dictatorial position has been permitted to potentially cause great harm to the economy of this county and will also cause small children to endure transportation times that are not only illegal per your own legislation but also inhumane.  Pre-K four year olds through grade Six students will have to spend time well over code mandates on the bus with this forced single school consolidation.  His decisions in no way consider the needs of our students and their families but are in keeping with a State bureaucracy whose actions reveal it is totally out of touch with what those needs may be.

Despite misreporting by the State DOE our schools make AYP.  We test at 14th in the State.  We have little truancy and our students graduate.  We have never been in financial trouble.  We accept like all West Virginia schools must that there will be sacrifices to be made when the stimulus and guaranteed student monies run out but our board had been planning for that until the State got hold of the public check book.  These are statistics you can easily verify.  Did not one person think they should ask the people who pay the bills if we wanted to be their guinea pig for an inter-county school? This takeover was political in nature.

Brent, you are fully aware of all of this and more. Your coworkers Governor Tomblin, Delegate David Walker, Senator Joe Minard, Senator Jeff Kessler, Senator Douglas Facemire, Senator Larry Edgell, all of their aides to the constituency and legal aides have been contacted multiple times along with Chuck Heinline, Howard O’Cull, Mark Manchin, Gus Penix, Jorea Marple plus Gayle and Joe Manchin.

When calling the Statehouse, the first response anyone hears is “he’s not involved with education.  If that’s the case, then why is the Governor President of the SBA?  How do you have a Legislative Oversight Committee on Education Accountability or an Education Subcommittee on Education Audit and Fiscal Issues?  How did you create a required general education levy and tax the people of this state if you have nothing to do with education?

While we are at it, how can the State Superintendent approve any excess tax levy on the people?  What is going on our ballot in November is not a continuation of a previous levy which expires June 30th, 2013. And which was defined and voted to specifically support our four elementary schools for starters.  This levy is so loosely written as to give Mr. Blankenship full reign to send excess levy dollars out of county boundaries to a school that neither county voters nor their elected Board of Education representatives had any say about and if no change takes place will have no control over. The specifics of our prior approved levy are gone.  This is a newly written document and is a state assessed, excess levy with increased tax rates.  What part of WV Code gives the State Board of Education that authority? Jorea Marple signed it.  I can’t find the code reference and see this as taxation without representation.

Sir, if we cannot turn to our elected representative at the state level as next in line when our local elected powers have been stripped where do we turn?  You say you are not involved and in the same breath express that you “want to ensure that Gilmer County parents, students and other residents (I take it you mean the taxpayers who elected you and pay for the schools) have an equal say in how this school is governed? WE HAVE NO DULY ELECTED REPRESENTATION! OUR BOARD OF ED HAS NO AUTHORITY!  WE HAVE NO VOTE. Unless you decide that you really are involved in education, HOW CAN WE HAVE A VOICE IN THESE DECISIONS?  Don’t let this be another shallow political promise.

If we have no vote in the governance of this forced school and the consolidation we have no say. An advisory position is potentially meaningless and that is what the memorandum of agreement between the two counties that Jorea Marple and Ron Blankenship will sign states.

I certainly will do as you request and once more start making phone calls and sending emails. It is my hope that caring Gilmer County residents do the same.  We should not have to repeat ourselves over and over but must do whatever it takes to be heard.

It would be grand if Charleston, would not discount taxpayer efforts to seek fair, equitable and just treatment within our government and a quality education for the children of Gilmer County and this state.  It will indeed be a great day when those we trusted work for us and not around us.  I truly believe you have that capability and if Gilmer County ever needed a strong legislator working in our best interest the time is now. We realize you are not alone in this and that should be communicated   I thank you for your time and hope to meet with you soon.

Lonnie Lee Stout

Age 39, of 88 Alkire St Walkersville, WV passed away on Thursday, August 23, 2012 at his residence following a sudden illness.

He was born in Lockport, NY on January 22, 1973: son of Gary Stout and Jacqueline (Wrobel) Stout.

On June 10, 2005, he married Eva M. (Cutlip) Stout, who survives.

Lonnie is also survived by two children Katherine Stout and William Taylor both at home. He is also survived by one sister: Shannon Stout Hitt of Linn, WV.

Mr. Stout was a dismantler with Jordan Auto Parts of Clarksburg. He enjoyed restoring antique vehicles.

At Lonnie’s request, there will be a memorial service at a later date and interment in Forest Lawn Memorial Gardens of Jane Lew, WV.

Hardman-Paletti Funeral Home of Weston is in charge of arrangements for Lonnie Lee Stout.
