Gilmer County Circuit Court Report - 03.08.10

image

On Wednesday, March 03, 201 Chief Judge Jack Alsop heard 2 juvenile cases and transferred the Fugitive from Justice case of Ross Lee Marks back to Judge Richard A. Facemire for disposition because Facemire had recently sentenced Marks in a Gilmer County felony case.

On Thursday, March 04, 2010 the Circuit Court room was very full with 13 attorneys, many defendants, various police officers, witnesses, and friends and family members appearing for criminal docket call.

Nine pages of cases were docketed, and although Judge Alsop eventually called the cases that needed capias’ renewed in them, he first called and set the docket for pleas and trials.

Criminal trials were set for Wednesday, March 10, 2010 (the first day petit jurors report), Tuesday, March 16; Tuesday, March 23; Tuesday, June 01 and Thursday, June 03, 2010 as follows:

Wednesday, March 10, 2010 will see State vs. Jessica Self as the first trial.
Ms. Self is charged with 19 counts of embezzlement and is represented by R. Russell Stobbs of Weston.

The second trial that day will be State vs. Adam Batton
Who is charged with 3 counts of delivery of a Schedule I controlled substance, and is represented by Christopher Moffatt of Charleston.

Third trial set for March 10th is State vs. Audrianna Claypool
Charged with 2 counts of delivery of a Schedule I controlled substance, 1 count of delivery of a Schedule II controlled substance and 1 count of conspiracy.
She is represented by Christina Flanigan of Buckhannon.

The first trial set on Tuesday, March 16, 2010 is State of WV vs. Christopher Yoho

Who is charged with 1 count of Delivery of a Schedule I controlled substance, 1 count of Delivery of a Schedule II controlled substance and 2 counts of Delivery of a Schedule III controlled substance and 1 count of conspiracy.
He is represented by R. Russell Stobbs of Weston.
A plea bargain is being considered in this case.

June 1st the trial of State vs. Christopher McVaney
Charged with 1 count of child abuse resulting in injury will take place.
Special prosecutor Kelly Hamon McLaughlin (the Braxton County Prosecuting Attorney) will try this case for the state and McVaney is represented by R. Russell Stobbs.

June 3rd the trial of Seth Seelbach will occur.
Seth is charged with 2 counts of conspiracy and Judge Alsop heard pre-trial motions in Seelbach’s case on 03.04.10 in a closed Court room, and ordered Prosecutor Houghto contact state police officer Shingler and cause him to appear forthwith in the Court room to produce ALL evidence in this case.
Judge Alsop also wanted to see a copy of a January 15, 2010 letter written by Gerry Hough to Senior Trooper Jared Brewer and Sgt Andrew Shingler with copies sent to both Judges and Colonel Timothy Pack of the WVSP.
After nobody could produce a copy of this letter, Circuit Clerk Karen Elkin stated she had a copy of it in her office and thereafter produced it to the Judge.

Twenty-eight (28) cases where defendants have never appeared before the Court (some cases having been filed 10 years ago) saw orders signed by the Judge renewing capias’ in them.

In the matter of State vs. Travis Buford, Hough presented a dismissal order to be signed by Alsop.

In State vs. Larry Michael Snider
He appeared with his attorney, Jason M. Glass of Jane Lew, and moved the Court for a competency evaluation.
Whereupon Judge Alsop placed Snider in the custody of Sheriff Mickey Metz to be transported to Central Regional Jail to await an appointment for his evaluation.

A suppression hearing was conducted in the case of State vs. Darriel Craig.
Chief John Moss testified in the hearing and his case was set for trial.

In the case of State vs. Billy Tomblin this matter is before Judge Facemire, who took the plea bargain under advisement and set the matter for Monday, March 22, 2010.

GSC Music Audition Day A Success

image

The annual Glenville State College Department of Fine Arts ‘Music Audition Day’ held on Tuesday, February 23, 2010   is being called a success.

The event took place from 8:00 AM to 5:00 PM and was held in the GSC Fine Arts Center.

Eleven students from across the state auditioned giving them an opportunity to receive scholarships from the GSC Music Department.

Due to inclement weather, the original date of February 16th was cancelled. Some students could not attend the event on the day it was rescheduled, so other audition times are being scheduled during the remainder of the semester.

“During auditions, we listen to students perform scales, etudes, solos, or whatever type of music they prepared for us to listen to. We speak to them concerning their grades, ACT scores, their high school activities, honor bands/choirs they may have been involved in, their career goals, and other important information,” said GSC Department of Fine Arts Chair Lloyd Bone.

‘Music Audition Day’ participants also meet the entire GSC music faculty as well as talk to select members of GSC administration, see performances by all the major ensembles, eat lunch with current GSC music program students.

To schedule an audition time or for more information, contact GSC Department of Fine Arts Assistant Sheri Skidmore at “Sheri.Skidmore@glenville.edu” or at 304.462.4130.

Delegate David Walker - 03.08.10

image

West Virginia is known for some of the most loyal, hardworking and trustworthy Americans around. We are a state built on labor, neighborly families, and mutual understanding.

Throughout the legislative session, I think about the great families of West Virginia and different ways in which I can help their everyday lives.  This past week, I had the great honor of watching three of my sponsored bills get passed and feel a step closer to ensuring the future success of this great state.

One such bill is House Bill 4397.
This bill would require an increase to a minimum of 800 state troopers by July 1, 2014. This will not only add more jobs to this state, but will make us all more safe in our everyday lives. The state troopers perform a priceless service for our families - we know this. But what we don’t know, or think about, is how hard their work is. These extra men and women will increase the troopers’ efficiency and effectiveness throughout West Virginia.

I also was thrilled to see House Bill 4669 pass the house.
This bill would greatly help our teachers and education system by allowing certain exceptions from particular state statutes for those schools who fall under the innovation zone. Our children’s future is too precious for this bill not to pass. Anything that encourages educational innovation is a winner in my book.

No part of the educational process should be overlooked but I feel as if that is often done.

This past week, I helped pass House Bill 4512 in order to help School Bus Operators in this fine state.
This bill updates laws about certification testing, wages of those training school bus operators, and the definition of a “supervisor of transportation.” With this bill, we can help a group of hard working employed persons as well as the overall system of school transportation, and I sincerely hope it passes the Senate.

We now have few days left in our legislative session. They will be full of debate, deliberation and hard work as us legislators iron out the details for new and changed state laws. I can make only one guarantee: anything I pass will help this state achieve its fullest potential.

Together we can make West Virginia continue to prosper and continue to grow.

WV Career Centers to Get Computers, Broadband Access

image

West Virginia is getting $1.9 million in federal economic stimulus money to replace computers and expand technology at 20 workforce training career centers.

Workforce West Virginia One-Stop Career Centers, which serve job seekers, plan to replace 165 computers and add 80 new computer workstations. All computers will have high-speed Internet broadband access.

The expanded career centers are expected serve an additional 2,300 people a week statewide. Each center will have Wi-Fi access for job seekers who bring their own laptops.

The federal grant will fund technology improvements at 13 comprehensive One-Stop centers and seven satellite offices. The centers, which offer training, referrals and career counseling, will stay open an additional six hours per week.

Workforce West Virginia hasn’t replaced career center computers in years because of limited federal funding. Many of the computers are unreliable. The new computers will run software to help people take online job training classes.

Each center also will receive video conferencing equipment, which can be used for training and job interviews.

Workforce West Virginia plans to install special computer workstations for people with disabilities. The workstations will have a device to produce text in Braille, as well as voice-recognition software.

Ask the Doctor: Vitamin Is Needed for Good Health

image

DEAR DR. DONOHUE: I am an 81-year-old woman in good health. After a favorable checkup recently, the doctor told me I should have a vitamin B-12 shot every month for the rest of my life. I am not anemic. I have always been reluctant to take pills and shots of any kind. I am puzzled about this suggestion.
- G.M.

ANSWER: Vitamin B-12 is an essential ingredient in the production of red blood cells and in the maintenance of nerve health. It’s a unique vitamin. It is found only in meat. In addition, it requires intrinsic factor for its absorption. Intrinsic factor is made in the stomach. It takes B-12 by the hand and ushers it into the blood through the intestinal wall. Without intrinsic factor, B-12 leaves the body. A deficiency of the vitamin gives rise to pernicious anemia and leads to nerve and the spinal cord damage. You have no signs of either, and all your lab tests are OK.

At older ages, the production of intrinsic factor wanes, and that’s the reason pernicious anemia is more common then.

Since people with intrinsic factor deficiency cannot absorb B-12, doctors in North America treat the deficiency with shots. The shots bypass the need for intrinsic factor. Doctors in Europe give large oral doses of the vitamin, and some of that oral dose is absorbed.

I, too, am puzzled why your doctor wants you to take B-12 shots. At one time, they were given as a tonic for people complaining of weakness and lethargy. That’s not done much these days. Why not ask the doctor for his reasons for wanting you to have shots? You’ve roused my curiosity. Let me know what he says.

Daily Prayer - 03.09.10

image

Gracious God, the leaves have fallen, the air has become cold, and bare trees now seem to open the sky.
Remind me that this is a time to slow down in order to be attentive to the stark stillness winter brings.
Help me breathe deeply the frigid air and know myself to be held in the warmth of your love.
When the sun is high, let me look up and be bathed in your gift of winter’s gold.
When the moon lights up the night, let me look up and drink in your gift of snowy calm.
I ask this for the sake of your love.
Amen.

image

James (Jim) Alvie Davis Jr.
Age 59, died early Saturday, March 06, 2010 at his home in Sutton surrounded by his family.

Jim battled complications with diabetes over the last several years, although his health never prevented him from his favorite activities of storytelling and helping friends.

Born on Coon Creek, Jim was a gifted storyteller often sharing stories from his youth. He was also a talented repairman. His ingenuity allowed him to utilize all available resources to solve a problem. Even though he could no longer make repairs himself, many would call him to seek advice. Jim was capable of talking even the most inexperienced person through a vehicle repair over the telephone. He will be remembered for an everlasting upbeat demeanor. Through the many struggles with his health, he was always quick with a joke. In his own words, “No matter how many operations I have had, they still haven’t removed my sense of humor.”

He is survived by his wife of nearly 36 years, Pamela Davis and three daughters: Melissa Davis Gee, of Louisville, KY, Diana Kathleen Davis, of Sutton, and Melanie Davis Marshall, of Boone, NC, and sons-in-law Gene Gee and Kevin Marshall. As well as many “adopted” children who frequently sought his advice and enjoyed his company.

Jim was preceded in death by his parents James Alvie and Orpha Davis and siblings, Jack James, Robert Duffield and Carol Hoard.

Jim was retired from Go Mart Inc.

The family held a private service at home.
